TERMS AND CONDITIONS OF USE

PLEASE TAKE A FEW MINUTES TO READ THESE TERMS CAREFULLY. THEY RELATE TO YOUR USE OF EQUAL JUSTICE’S WEBSITES AND ANY OF THE SERVICES OFFERED.

The equaljustice.org and pregnantatwork.hk websites (the “Websites”) are owned and operated by Equal Justice Limited (“Equal Justice”, “we”, “us” or “our”). Your use of these Websites and any of the services offered on or via the websites (the “Services”) are subject to these Terms and Conditions of Use (the “Terms”).

By using the Websites and any of the Services you agree to be bound by these Terms. If you do not agree to be bound by these Terms, please stop accessing or using these Websites and/or the Services.


USE OF OUR WEBSITES AND SERVICES

1. You may use our Websites and Services for personal purposes only. You must not use any of the information and materials on our Websites for commercial purposes.

2. You may not under any circumstances:

a. Copy, sell, resell, assign, licence, distribute, transmit, publicly display, rent, lease, offer on a “pay-per-use” basis, publish or otherwise reproduce the Websites in any form by any means;

b. Adapt, modify, decompile, disassemble, localise, port and/or reverse engineer the Websites;

c. Remove, obscure or destroy any copyright, proprietary or confidential legends or marking of Equal Justice placed upon or contained within the Websites; and or

d. Prepare or develop derivative works based on the Websites.

3. Your access to and use of the Websites and Services does not create a legal contract or promise between Equal Justice and you.

4. We are not a law firm. The information and materials on the Websites should not be taken as legal or other professional advice from a qualified advisor, are not intended to be a substitute for legal advice and should not be relied upon as such. You should seek legal or other professional advice in relation to any particular matter you may have.

5. You use the Websites, Services and any of the information and materials on the Websites entirely at your own risk. We make no representations or warranties, whether express or implied, that the information and materials on our Websites is accurate, complete or up-to-date. To the extent permitted by law, we exclude all warranties and conditions, either express or implied.

6. We are not responsible for the content of external internet sites that link to our Websites. Where our Websites contain links to other external internet sites, these links are provided for your information only. Such links should not be interpreted as our endorsement, approval or verification of those linked websites and are accessed at your own risk. We have no control over the content of those sites.


EXCLUSION OF LIABILITY

To the extent permitted by law, Equal Justice, our related corporations, our third party providers and each of their officers, directors, employees, agents, independent contractors, successors and assigns disclaim liability for any losses arising from or in connection with any access or reliance on information and materials contained on the Websites or any other external internet sites linked through the Websites.


DATA PRIVACY & SECURITY

1. By accessing and using the Websites, you agree that we can collect, use and disclose any personal data (as defined under section 2 of the Personal Data (Privacy) Ordinance (Cap. 486, Laws of Hong Kong)) you provide to us in accordance with our data protection policy (which may be found on this website or via https://www.equaljustice.org/privacy-policy), as may be updated and/or amended by us from time to time.

2. In addition, by using the Websites, you consent to having certain anonymous data collected to help us understand how the Websites are being used and how we can improve them. This data is gathered automatically and includes, but is not limited to, your computer’s IP or “Internet Protocol” address, statistics about how you access or use the Websites, and information provided through the use of “cookies”.


1. The Intellectual Property Rights in and to the Websites and all information and materials on the Websites are owned, licensed to or controlled by Equal Justice, our licensors or our service providers. We reserve the right to enforce our Intellectual Property Rights to the fullest extent of the law.

2. You may be permitted to download, print or use the Websites, and any of their information, content or materials, provided that:

a. It is for your general information only (and not considered legal advice);

b. It is in its complete form and is for your personal use or non-commercial purposes within your not-for-profit organisation, with Equal Justice (and relevant licensors) clearly acknowledged as copyright owner and links and disclaimers retained;

c. You do not modify any part of the content on the Websites and that Equal Justice and/or the relevant copyright owners retain all copyright and other proprietary notices contained in the Websites and its information, content or materials; and

d. You do not publish or re-produce (such as replicate the Equal Justice materials, information, content or any part of the Websites on another website or newsletter) without our prior written approval or that of the relevant copyright owners.

3. All other rights are reserved. You note that specific materials on the Websites (such as publications) may have their own specific copyright notices.

4. You may provide links to these Websites provided that the links are clearly acknowledged and are not framed by advertising or any images or materials which may mislead or deceive a person as to the source or the author of Equal Justice’s materials.

5. The Trademarks are registered and unregistered trademarks of Equal Justice or third parties. Nothing on the Websites and in these Terms shall be construed as granting, by implication, estoppel, or otherwise, any licence or right to use (including as a meta tag or as a “hot” link to any other website) any Trademarks displayed on the Websites, without the written permission of Equal Justice or any other applicable trademark owner.

6. For the purposes of this section:

a. “Intellectual Property Rights” means trademarks, service marks, rights in trade names, business names, logos or get-up, patents, rights in inventions, registered and unregistered design rights, copyrights, database rights, rights in domain names and URLs, rights protecting goodwill and reputation, and all other similar rights in any part of the world including where such rights are or may be obtained or enhanced by registration, any registrations, applications for registration and rights to apply for registration.

b. “Trademarks” means the trademarks, service marks, trade names and logos used and displayed on the Websites.

INTELLECTUAL PROPERTY


1. We may at any time, without giving any reason or prior notice, upgrade, maintain, modify, alter, suspend, discontinue the provision of or remove, whether in whole or in part, the Websites and shall not be liable for any loss caused to you by such upgrade, modification, suspension or alteration.

2. We reserve the right, but shall not be obliged to:

(i) monitor, screen or otherwise control any activity or content;

(ii) investigate any violation of these Terms and take any action deemed appropriate;

(iii) prevent or restrict your access to the Websites and/or Services; and/or

(iv) report any activity suspected to be in violation of any applicable law, statute or regulation to the appropriate authorities and co-operate with such authorities.

3. Termination of the Websites for any reason shall not bring an end to your obligations under any provisions of these Terms which are meant to survive the termination.

RESERVATION OF RIGHTS


To the extent permitted by law, you agree to defend, indemnify and hold harmless Equal Justice, our related corporations, our third party providers and each of their officers, directors, employees, agents, independent contractors, successors and assigns, from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including legal fees on a full indemnity basis) arising from or relating to:

(i) your use of and access to the Websites and/or Services;

(ii) your violation of any provision of these Terms; or

(iii) your violation of any third party right, including any copyright, property, or privacy right in connection with your use of the Websites and Services and all information and materials on the Websites.

INDEMNITY


1. These Terms contain the whole agreement between you and Equal Justice relating to the matters dealt within it.

2. If any provision (or part of any provision) of these Terms is invalid or unenforceable, the validity or enforceability of the remaining provisions (or parts thereof) shall not be affected and the other provisions (or parts thereof) shall remain in full force and effect as if the invalid or unenforceable parts had been deleted.

3. No failure or delay in exercising our rights under these Terms shall operate as a waiver nor shall such failure or delay affect our right to enforce our rights under these Terms.

4. You may not assign your rights under these Terms to anyone without our prior written consent. We may assign our rights under these Terms to any third party.

5. These Terms will bind you and us, and Equal Justice’s respective successors in title and assigns. These Terms will continue to bind you notwithstanding any change in Equal Justice’s name or constitution or Equal Justice’s merger with any other entity (in which case these Terms will bind you to our successor entity).

GENERAL


We may, at any time without notice to you, make amendments to these Terms as we may at our discretion deem fit from time to time. If you do not agree to be bound by the amendments, do not use the Websites and/or Services. You further agree that if you continue to use and/or access the Websites and/or Services, such use and/or access shall indicate:

(i) acknowledgement by you of these Terms and its amendments; and

(ii) agreement by you to abide and be bound by these Terms and its amendments.

AMENDMENTS


These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR. You and Equal Justice hereby agree that any dispute arising out of or relating to these Terms must be determined by the courts of Hong Kong SAR, which will have exclusive jurisdiction.
